Privacy and cookie policy

FruCare designs and sells dried fruit slices and related products. This policy explains which personal data we process when you visit our webshop, place an order, contact us or take part in our marketing and reviews.

1. Who is responsible?

2. Which data and for what purposes?

  • Orders, delivery and invoicing: name, contact details, billing and delivery addresses, products ordered, quantities, payment status, order history and, for professional purchases, company and VAT details. This data is needed to fulfil your order and maintain our legally required records.
  • Customer account and customer service: your account details, preferences and the content of messages, questions, complaints and any attachments. We use these to manage your account and help you.
  • Payment, security and fraud prevention: payment and transaction data and relevant technical data, such as IP address, device and browser information. Payment services process the data needed to handle the payment securely.
  • Newsletters and marketing: your contact details, subscription and unsubscribe information and, where permitted, your interests and interactions to make communications and product recommendations more relevant.
  • Reviews: the name you provide for publication, your review, product information and any photos you submit. Public reviews and images submitted with them are visible to other visitors. Do not share other people’s data in them without a valid legal basis.
  • Website use: necessary session data and, after your consent where required, data about visits and interactions for analytics, personalisation and advertising.

3. On what legal basis do we process data?

We process data to perform your contract or respond to your request before a purchase, to meet legal obligations such as invoicing and accounting, and for legitimate interests such as customer service, security, fraud prevention and handling disputes. We weigh these interests against your interests and rights.

Where consent is required, we request it beforehand, for example for optional tracking and certain marketing activities. Placing an order, creating an account or choosing a language does not in itself constitute consent to marketing. You may withdraw your consent at any time without affecting the lawfulness of earlier processing.

4. Cookies, language choice and shopping cart

Our webshop uses cookies and temporary browser storage to ensure that your cart, checkout, language choice and delivery country work correctly. These necessary functions remain available when you refuse non-essential cookies. If you also block or delete all necessary cookies through your browser, your cart, login and checkout may no longer work correctly.

On a first visit, Shopify may use your browser language and estimated location to suggest or display a suitable version of the shop. You can change the language and delivery country yourself. Your own choice takes priority over automatic detection during the rest of your visit. The final delivery address determines the available shipping options and costs at checkout.

FruCare uses temporary session storage per tab for the delivery country and shipping bar. This may store the delivery country, currency, product identifiers, cart quantities and amounts and, when needed to check shipping, postcode and province. This data is used to display the correct language and shipping information and is not used for advertising tracking for this purpose.

Storage Purpose and validity period
Delivery country Remembers the selected delivery country within the tab’s session. A manual choice remains valid for up to 30 days if the browser session is retained that long; an automatically detected country for up to 24 hours.
Shipping bar Keeps shipping information for the current cart. A checked shipping rate remains valid for up to 10 minutes; the temporary display status for up to 24 hours within the tab’s session.

This session storage used by FruCare normally disappears when the tab is closed. Browsers that restore a previous session may retain session data. The validity checks described above prevent old data from subsequently being reused as current information.

Shopify also uses its own necessary cookies. According to Shopify’s current cookie list, the cart cookie can retain the cart for up to 2 weeks and localization the country for up to 1 year. The exact cookies and their durations depend on the Shopify features used. You can delete cookies and browser storage yourself through your browser.

Non-essential cookies for personalisation, analytics and marketing require prior consent. You can refuse these cookies or change your choice later through the cookie settings without losing the ability to shop or change language. Your language choice does not constitute consent to marketing.

You can reopen the cookie settings using the cookie icon in the webshop footer. This icon also appears in the shipping bar while not all optional categories have been allowed.

5. Who do we share data with?

We only share data needed for the relevant purpose with parties that support us with the webshop, payment, administration, customer service, reviews, marketing, production and delivery. Depending on the service used, these include:

  • Shopify: hosting and operation of the webshop, customer accounts, cart, checkout and related services;
  • payment services: the provider selected at checkout, such as PayPal, Bancontact or other payment providers offered;
  • production and logistics partners: including social enterprise WEBO and the chosen carrier, such as DPD or bpost, to the extent that data is needed for packaging, dispatch and delivery;
  • review services: Judge.me for processing and displaying product reviews and the associated submitted content;
  • marketing partners and communication platforms: including Digital Leader, to the extent that they carry out the relevant marketing activities and lawfully need data for them;
  • administrative service providers, advisers and debt collection partners: for accounting, invoicing, advice and the lawful collection of unpaid invoices;
  • competent authorities: where required by law, for example in relation to taxation or food safety.

Appropriate agreements on processing and security are required for parties acting as processors on our behalf. Some parties, such as certain payment services and platforms, also process data under their own responsibility. Their own privacy information then also applies.

6. Multomato and social media

Multomato currently supports FruCare in publishing company and product images supplied by FruCare on social media. For these publishing activities, we do not share customer or order files or photos submitted by customers with Multomato.

If you respond to a social media post or contact us through a social platform, that platform processes data under its own privacy policy. Publishing our company images does not give permission to use your personal data for new marketing purposes.

If we expand the activities of Multomato or another marketing partner and have them process personal data as part of that work, we first assess the specific data, purposes, roles, retention periods and required agreements. We update this privacy information and request consent where needed.

7. Analytics, advertising and embedded content

We may use services from analytics and advertising platforms to understand how the webshop works and display relevant communications. Optional tracking for analytics, personalisation and marketing is only used after consent where required. You can change your choice through the cookie settings.

Embedded content from other websites, such as videos or social media content, may establish a connection to that service. If non-essential cookies or similar tracking are used for this, prior consent is required. If you click through to an external website, that website’s privacy rules apply there.

8. Processing outside the European Economic Area

Some service providers may process data outside the European Economic Area. Where this happens, the required safeguards must apply, such as an applicable adequacy decision or standard contractual clauses and, where necessary, additional measures. You may ask us which safeguards apply to a particular processing activity.

9. How long do we keep data?

We do not retain personal data longer than needed for the purpose for which it was collected, taking into account legal obligations and the handling of possible disputes.

  • Order, invoice and accounting data is retained for as long as the applicable statutory retention obligations require.
  • Account and service data is retained for as long as needed for the account, the services and the handling of questions or disputes. Data that must be retained by law is not automatically deleted when an account is closed.
  • Marketing data is used for as long as a valid legal basis exists. After an unsubscribe request, a limited record of that request may be retained to respect your choice.
  • Reviews remain published for as long as appropriate for their purpose, unless deletion is necessary or a justified deletion request is granted.
  • The validity periods in the cookie section above apply to our own browser storage.

You can contact us for information about the specific retention period for your data.

10. Your rights

Subject to the statutory conditions, you may request access, rectification, erasure, restriction of processing and portability of your data. You may object to processing based on a legitimate interest and may always object to direct marketing, including associated profiling.

Send your request to office@frucare.shop. We may request information needed to verify your identity. We generally respond within one month. If the law allows an extension due to the complexity or number of requests, we will inform you within that first month.

11. Direct marketing

You may unsubscribe at any time through the unsubscribe link in our marketing emails or by contacting us. Necessary messages about an order, payment or account are not marketing and may still be sent when needed.

12. Complaints

Please contact us if you have a question or complaint about your data. You also have the right to lodge a complaint with the Belgian Data Protection Authority: Drukpersstraat 35, 1000 Brussels, Belgium, contact@apd-gba.be, +32 2 274 48 00. You may also contact the competent supervisory authority in your country where the law provides for this.

13. Changes

We may amend this policy if our services or the applicable rules change. An amended text does not replace required consent or provide blanket permission for new processing.
